Whilst we continue our best endeavours to ensure the security of our website, we accept no responsibility or liability for any misuse of the site or materials within. By making use of a Brookfield Photography password to log in to this site you warrant that you are, or have permission from the legal guardian of the photographed subject(s) to do so. We accept no responsibility or liability should a third party use this information to gain access to online content for unauthorised or illegal purposes either prior to the legal guardian receiving this information or after, when in the care of the legal guardian or authorised user. Furthermore, we take no responsibility or liability should an unauthorised party gain access via an authorised user's computer or e-mail sent via an authorised user's computer. Displaying of Images When available, small unprintable images of the photographed subject(s) will be displayed upon a successful log in. The image is held on a secure server and access to these images can only be gained via the Brookfield Photography password. These details are unique for each photographed subject(s). As an added security measure we have ensured that once logged in to the site, the images cannot be saved, copied or downloaded. The images are screen resolution only and their only purpose is for proofing and identifying the subjects as an aid to placing an order. However, if the subject(s) legal guardian would like the image removed from the secure server they should send an email quoting the proof number and Brookfield Photography password but please be aware that all this will do is prevent the legal guardian from choosing from a wider range of order options.


Delivery


Standard Delivery to the UK mainland is £3.00 whatever the size of your order. We aim to despatch orders within 14 days but please allow 21 days for delivery. If for any reason you have a query regarding the delivery of your order, please email us. Please remember to include your full name, telephone number and the order reference quoted online when corresponding by email. For overseas orders (including Ireland & Channel Islands) please email us or telephone us on 01527 460154 for a delivery quote. Unfortunately, we will not be able to process your order via our website but our staff will help you over the phone. Should you encounter any difficulties whilst placing your order, please call us on 01527 460154.


Returns Policy


We check all prints before leaving the lab and take great care in packing your order to ensure that they arrive in pristine condition. However, if you do find a fault with your order, please return to us within 14 days and a replacement will be sent out as soon as possible. Please make sure to include a note detailing the reason for return. This note must include your order number. We will refund your postage costs only if the fault occurred whilst your order was in our care. Note: For your protection, we recommend that you obtain a certificate of posting when returning your order. (Available from the post office at time of posting)


Copyright


Please note that the copyright for all of the pictures on this site belongs to Brookfield Photography who captured the image. Their sale is restricted to private use and they cannot be printed from the screen, copied, distributed, published or used for any commercial purpose without the written consent of the Brookfield Photography who holds the copyright. There may be an additional fee to pay. Wedding packages that are sold specifically as JPG images are shared copyright between Brookfield Photography & the purchaser.

What we need

 

Brookfield Photography will be the ‘Controller’ of the personal data you provide to us.  With any purchase, we collect basic personal data about you including name, address, email and phone numbers .

Why we collect your data

We need your basic personal data in order to provide you with our service. We will not collect any personal data from you that we do not need in order to provide and oversee this service to you.

What we do with your data

 

All the personal data we hold is processed by our staff in the UK however for the purposes of IT hosting and maintenance this information is located on servers within the European Union.

No 3rd parties have access to your personal data unless the law or our contract with you, allows them to do so.

We have a Data Protection regime in place to oversee the effective and secure processing of your personal data.

How long we keep your data

We keep your images for the length of time agreed upon in our contract with you, after which time they will be deleted.

What we would also like to do with your data

We do not use your name and email address to inform you of our future offers and similar products. Any such offers are confined to paid advertising methods, social media or our website.

What are your rights?

 

If at any point you believe the information we process on you is incorrect you can request to see this information and have it corrected or deleted. If you are not satisfied with our response or believe we are not processing your personal data in accordance with the law you can complain to the Information Commissioner’s Office (ICO).

Safe Technology: Our Secure Sockets Layer (SSL) Thawte Server software enables us to provide the highest industry standard of 128-bit-encryption. It is among the best and strongest of the software available today for secure online commerce transactions. It encrypts all of your customer's personal information, including credit card number, name, and address, so that it cannot be read.


Booking Conditions


Brookfield Photography can not be held responsible for adverse weather conditions, errors made by third party labs or mechanical failure of equipment. Every effort will be made to ensure a close to life reproduction but due to the chemical nature of the print a perfect match can not be guaranteed. Brookfield Photography reserves the right to display images for advertising on websites, brochures etc for the sole benefit of Brookfield Photography. Any deposit paid is only accepted on a non refundable basis.


Creative Licence


Brookfield Photography shall be granted be granted creative and artistic licence in relation to the choice of locations and poses used. Our judgement on photographic style and the number of photographs taken shall be deemed as correct, due to changes in weather conditions and the availability and the willingness of subjects. We will do our best to honour requested photographs but do not undertake to guarantee any specific picture nor incorporate any specific background, location or group arrangement.




Terms & Conditions


In the following terms & conditions “the photographer” shall mean Kay Elizabeth Kemp trading as Brookfield Photography. “The clients” shall be those persons defined as bride and/or groom on the booking form or anyone being photographed by Brookfield Photography their prent or guardian in the case of minors. These terms & conditions cannot be varied in any way by the clients unless such conditions are expressly agreed by the photographer in writing.

The copyright for all of the images on this site belongs to The photographer who captured the image. Their sale is restricted to private use and they cannot be printed from the screen, copied, distributed, published or used for any commercial purpose without the written consent of the photographer who holds the copyright. There may be an additional fee to pay.

Force Majeure:


The photographer will endeavour to put the client(s) in touch with another photographer in the event they are unable to attend on the wedding date due to any cause beyond their reasonable control e.g. sudden illness, injury, victim of crime, flooding etc.

o In the event of cancellation by the photographer, or in the very unlikely event of total photographic failure, liability shall be limited to a full refund of any fees paid.

Additional Specific Wedding Photography Terms and Conditions

These terms & conditions cannot be varied in any way by the clients unless such conditions are expressly agreed by the photographer in writing.


Copyright:


The copyright Designs and Patents Acts assign the copyright of the images to the photographer.


Display:


The client(s) hereby allow(s) the photographer to display any photograph covered by this contract and to generally promote the business in advertising, brochures, magazine articles, websites, social media, sample albums etc.


License, Coverage and Reproduction:


Photographs taken during the course of the event will be at the discretion of the

photographer although every effort will be made to comply with the clients requirements.

The photographer shall be granted artistic license in relation to the poses photographed and the locations used. The photographer’s judgement regarding these matters shall be deemed correct.

The photographer shall endeavour to photograph all individuals as requested by the client(s) at some point, but no responsibility will be taken by the photographer on the occasion of leaving somebody out.

For a booking involving a church ceremony or at certain venues, the photographer’s movements are sometimes restricted by the official in charge. The area from which the photographer is able to cover the ceremony may not be the photographer’s choice and the photographer cannot accept responsibility for any obstructed view should this be the case.

Due to a variety of lighting conditions and the limitations of digital sensors, some colours may alter throughout a set of photographs.

Although all equipment is checked regularly and reasonable steps are taken to ensure backup equipment is available, the photographer will not be responsible for photographs that are not produced due to technical failure.


Prices:


o All standard wedding packages and additional goods specified on the booking form

are supplied at the prices ruling on the date of booking. Goods not specified on the booking form are supplied at the prices ruling at the time of receipt of the order.


Payments:


A non-refundable booking fee of £150.00 will confirm your booking, as well as full acceptance of the terms and conditions as published on the photographer’s website. The booking fee will be deducted from the cost of the client’s chosen package when calculating the final balance due. Payment in full of the remaining balance will be due one calendar month before the wedding day.

Additional goods ordered must be paid for in full at the time of ordering.

Titles to all goods remains with the photographer until paid for in full by the client(s)


Force Majeure:


The photographer will endeavour to put the client(s) in touch with another photographer in the event they are unable to attend on the wedding date due to any cause beyond their reasonable control e.g. sudden illness, injury, victim of crime, flooding etc.

In the event of cancellation by the photographer, or in the very unlikely event of total photographic failure, liability shall be limited to a full refund of any fees paid.


Ownership:


All digital negatives (computer files) remain the property of the photographer. On occasion, the photographer may supply a copy of the edited digital files to the client(s) for their own non-commercial use.


Cancellation Fees:


If the client(s) should have to cancel a booking the following cancellation fees will become due immediately upon said cancellation:


Cancellation from the booking date and more than three months to go until the wedding, the booking fee of £150.00.


Cancellation with less than three months to go until the wedding date, full price for the complete photographic coverage booked. Where no package has been specified on the booking form, it will be deemed that the client(s) have chosen a package to the value of £1295.00. The client(s) are hereby advised to take out an appropriate insurance policy to cover any expenses incurred in the event of cancellation.

Where the photographer is able to re-book the date with an equivalent booking then the cancellation fee will be reduced to the booking fee.


On The Day & Optional Evening Cover


The photographer is the only authorised and official photographer for your wedding day. The latest the photographer will work to on any wedding day is 9pm.


Optional Pre-Wedding Shoot

The pre-wedding shoot (PWS) takes place within a ten mile radius of Redditch.


Personal Accident:


Any directions issued to clients, their guests or employees during a photographic shoot are deemed to be at said persons own risk. The photographer cannot be held responsible for any personal accidents during a photographic shoot.


Album Delivery:


All wedding albums are collected or posted to the customer via courier at extra cost.

This fee is currently £11.00.

Additional Special Terms and Conditions for  Cake Smash Promotions


Child must be able to sit up and feed them self cake without adult assistance

Promotion elements i.e. Cards, Jpg file and the print must be all of the same image

As the printing technics for the cards and print are different chemical processes an exact colour match cannot be guaranteed
